Terms & Conditions

“Pro Bici” means Pro Bici La Santa [C/ Encarnacion 14, Tinajo, Lanzarote]
“You and your” means the person hiring the Bike from Pro Bici La Santa and identified on the hire form.
“Hire form” means the form signed by you agreeing to hire the Bike on these terms and conditions.
“Hire period” means the period of your hire of the Bike
“Bike” means a bicycle supplied by Pro Bici and hired by you subject to these terms and conditions.
“Damage Waiver Fee” means the fee described as such on the hire form.
“Hire charges” means the amounts payable by you for the hiring of the Bike and other equipment.
RISK
You hereby agree that:
you are physically fit enough and have good eyesight sufficient to pass a driving test, to undertake cycling over any distance;
cycling is inherently dangerous and that you will use the bike at your own risk;
you will ride the bike responsibly and within your capabilities at all times;
you will not allow any third party to ride the Bike;
you will not take the bike off Lanzarote;
you will securely lock the bike to an immovable object when not riding it, and lock it indoors overnight;
you will not undertake any manoeuvre and/or route which is beyond your level of skill or which is unsuitable for the bike’s capacity;
you will not hold Pro Bici or its employees responsible for any loss, damage or injury including death to persons or property with regard to the use or hire of the Bike and/or equipment;
you will fully indemnify Pro Bici against all claims arising from death or injury to you and/or any third party and you will fully indemnify Pro Bici against all claims arising from damage to your and/or any third party’s property.
LIMITATION OF OUR LIABILITY TO YOU
Pro Bici shall have no liability to you in the event we are unable to fulfil a booking due to an event beyond our control.
HELMETS
You accept that cycle helmets have been offered to you by Pro Bici and strongly recommended by Pro Bici for you to use. It is mandatory by Spanish law to wear a helmet at all times while riding a bike.
The risks associated with your not wearing a helmet lie entirely with you.
DELIVERY AND ACCEPTANCE
Pro Bici at its discretion may agree to deliver the bike to you for a fee.
Delivery to or collection by you of the bike will only be made to/by you, once payment of the hire charges have been made in full by you to Pro Bici.
You hereby agree that you have inspected the bike, helmets and other equipment supplied with the bike prior to signing the hire form and accept them as wholly suitable for you to hire on these terms and conditions.
Any marks or damage to the bike, must be noted on the hire form by you prior to acceptance of the bike by you.
REPAIRS AND MAINTENANCE
Pro Bici agrees that:
The bike has been professionally maintained and serviced before delivery of it to you; and the cost of servicing, repairing and maintaining the bike resulting from fair wear and tear will be borne by Pro Bici.
You hereby agree that:
although the bike has been professionally maintained and serviced before delivery to you, components such as brakes, tyres, inner tubes, bearings and cables etc. may deteriorate during the hire period, and you accept this inherent risk to your use of the bike;
you will promptly notify Pro Bici La Santa of any damage to the bike, and any repairs or maintenance that may be required;
you will only use Pro Bici to carry out any servicing, repairs and maintenance that may be needed;
you will immediately pay the reasonable cost of repairing damage to the bike arising as a result of accident, however caused, or by misuse of the bike, or use of the bike not specifically in accordance with these terms and conditions.
RETURN OF THE BIKE
You hereby agree that:
You will return the bike and other equipment to Pro Bici La Santa before the end of the hire period;
Return must only be made in person to a Pro Bici employee;
You will return the bike and other equipment to Pro Bici in the same condition as when it was received by you, fair wear and tear accepted;
YOUR RESPONSIBILITY FOR LOSS OR THEFT OF THE BIKE
You hereby agree that:
You are liable and bear full responsibility for any lost, stolen or damaged bikes, or parts thereof, or other equipment and will immediately pay Pro Bici for the reasonable cost of loss or damage;
And you will immediately notify Pro Bici La Santa of damage to, or loss, or suspected theft of the bike or parts thereof.
NOT TO PART WITH THE BIKE
You hereby agree not offer for sale, sell, let, lend or otherwise part with possession of the bike or part thereof.
THIRD PARTY LIABILITY
You hereby accept full liability for any and all damages, costs, losses and claims from third parties relating to the hiring or use of the bike during the hire period.
You hereby agree to indemnify Pro Bici against any and all claims arising from third parties relating to the hiring or use of the bike during the hire period.
INSURANCE
The renter hereby agrees that it is their responsibility to have insurance in place to cover their hiring and use of the bike during the hire period.
Pro Bici does not offer insurance services.
DAMAGE WAIVER
If you pay the damage waiver fee prior to start of the hire period, Pro Bici will reduce the cost to you of any accidental damage to the bike by 50% of Pro Bici´s standard retail price.
FRAME PROTECTION
All bikes are protected with a Paint Protection Film (PPF). This is to preserve the bike for the next person to rent and ultimatly who will buy it after its life as a rental bike.
The road bikes are protected in 6 places see picture below.
The mountain bikes are protected in 8 places, see picture below.
If the PPF is damanged after the rental period. They will have to be replaced at a cost of 5€ per damanged piece
PAYMENT TERMS
A deposit of €50 per bike is required to secure a reservation.
This deposit will be applied to your hire charges and the remaining balance must be paid in full prior to delivery or collection of the bike.
Late return of the bike is not permitted without the prior approval of Pro Bici. If approval is given, the hire period will be extended, additional hire charges will be immediately payable. These Terms and Conditions will continue to apply.
Unauthorised or Unapproved late return of the bike will be charged at twice Pro Bici’s published daily hire rate.
Pro Bici shall have no liability to you in the event we are unable to fulfil a booking due to an event beyond our control.
CANCELLATIONS
30 days or more prior to your start date you have 3 options:
1. Switch to another date with no loss of deposit
2. Keep your balance on file for any future trip with no expiration *
3. Cancel your trip and receive a full refund.
14 days to 30 days prior to the start of the rental period you have 3 options:
1. Switch to another date for your trip with no loss of deposit
2. Keep your balance on file for any future trip with no expiration *
3. Cancel your trip and receive a partial refund of your deposit (50%)
14 days or less prior to your start date: no refunds!
